New Orleans councilman, attorney plead not guilty to fraud

New Orleans City Council President Jason Williams and an attorney in his law firm pleaded not guilty to federal tax fraud charges on Friday.
Williams, 47, and Nicole Burdett, 39, appeared remotely before a federal magistrate judge and entered their pleas to charges of conspiracy, preparing false or fraudulent tax returns and failing to file tax forms related to cash received, news outlets reported.
The two were charged in an 11-count indictment last month following a yearslong investigation led by the Internal Revenue Service and the FBI.
Williams, a criminal defense lawyer, was accused of inflating his business expenses from 2013 to 2017 in order to reduce his tax liability by more than $200,000, according to the U.S. Attorney’s Office for the Western District of Louisiana. The indictment also alleged Williams and Burdett, an attorney in Williams’ law office who also handled administrative duties, failed to file the proper reports on cash payments from clients totaling $66,516.
Williams’ attorney, Billy Gibbens, has contended his client was just following the advice of his tax preparer, saying the accountant made the errors on his own, according to The Times-Picayune/The New Orleans Advocate. Michael Magner, an attorney for Burdett, also said his client was innocent and did not have any role in the tax decisions.
Williams and Gibbens raised questions about the timing of the indictment as Williams prepares to challenge Orleans Parish District Attorney Leon Cannizzaro for the top prosecuting role. The campaign qualifying period for the Nov. 3 election is set to end July 24. Williams has said he still plans to run for the seat, according to The Times-Picayune/The New Orleans Advocate. A preliminary trial date for the case was set for Sept. 14. |

Town court in southern Nevada closes due to coronavirus

A town court in southern Nevada was closed Tuesday after officials said several workers were exposed to a person who tested positive for the new coronavirus.
The two judges in the Nye County community of Pahrump issued an order saying all staff members will be tested Wednesday for COVID-19, and no in-person hearings will be held at the courthouse.
Pahrump Justice Court will continue to conduct initial appearances, bail hearings and arraignments with detainees and attorneys appearing by telephone or video conference.
Applications for protective orders can be made by internet or at the Nye County sheriff’s office.
The court in the community about 60 miles (96.5 kilometers) west of Las Vegas also closed for several days in April after an employee tested positive and other workers were exposed to the virus.
The court order said officials anticipate reopening after staff members have tested negative.
State health officials report that more than 22,000 people have tested positive for the virus statewide and at least 537 have died.
For most people, the virus causes mild or moderate symptoms for up to three weeks. Older adults and people with existing health problems can face severe illness and death. The vast majority recover.

German far-right party wins court case against minister

Germany's top security official violated the rights of a far-right party by posting remarks criticizing it on his ministry's website, the country's highest court ruled Tuesday.
The Alternative for Germany party, known as AfD, whose anti-migration and anti-establishment stance helped it get into the German parliament in 2017, is currently the largest of several opposition parties.
Its case against Interior Minister Horst Seehofer stems from an interview that his ministry posted on its website in 2018, in which he decried a broadside by AfD against President Frank-Walter Steinmeier. AfD had accused Steinmeier of drumming up support for a “radical left-wing event” after he backed a left-wing punk group's anti-racism concert, and the party sought to debate his budget in parliament.
Seehofer described AfD's behavior as “undermining the state” and asserted that “they stand against this state. They can say 1,000 times that they are democrats ... this is highly dangerous for our state.”
The Federal Constitutional Court found that parties must be allowed to compete on an equal footing. Presiding Judge Andreas Vosskuhle said the legitimacy of the government's public relations work “ends where advertis ing for or exerting influence against individual parties or people in political competition begins.”
The court found that the government is entitled to defend itself publicly against criticism of its policies using official channels, but should avoid comments that have no substantial link to the criticism and are “distorting or disparaging.”
The verdict has no direct consequences for Seehofer. The interview was taken down from his ministry's website a little over two weeks after it was posted there.

Wood County commissioner reprimanded by Supreme Court

The Wisconsin Supreme Court on Thursday reprimanded a part-time Wood County circuit court commissioner for not removing himself from hearing a case involving an attorney who was a personal friend.
The court reprimanded part-time commissioner Kenneth Gorski after agreeing with the Wisconsin Judicial Commission's determination that Gorski had willfully violated several rules of the judicial conduct code. Gorski works about two afternoons a month as a part-time circuit court commissioner, a job he started in 2014.
The complaint stems from a small claims case that Gorski should have recused himself from because he was personal friends for more than 20 years with the attorney, the Supreme Court said. They went on four overseas vacations together between 2015 and 2018 as well as frequent overnight golfing trips, the Supreme Court said.
During the trial, Gorski lost his temper with the defendant who was opposed by his attorney friend, groaning in anger and making sarcastic comments, the Supreme Court said.
