Supreme Court set for case on racial bias in jury selection

Curtis Flowers has been jailed in Mississippi for 22 years, even as prosecutors couldn't get a murder conviction against him to stick through five trials.
Three convictions were tossed out, and two other juries couldn't reach unanimous verdicts.
This week, the Supreme Court will consider whether his conviction and death sentence in a sixth trial should stand or be overturned for a familiar reason: because prosecutors improperly kept African-Americans off the jury.
The justices on Wednesday will examine whether District Attorney Doug Evans' history of excluding black jurors should figure in determining if Evans again crossed a line when he struck five African-Americans from the jury that most recently convicted Flowers of killing four people.
In overturning Flowers' third conviction, the Mississippi Supreme Court called Evans' exclusion of 15 black prospective jurors "as strong a prima facie case of racial discrimination as we have seen" in challenges to jury composition. This time around, though, the state's high court has twice rejected Flowers' claims, even after being ordered by the U.S. Supreme Court to take another look. |

Court to rule on Newtown shooting lawsuit against gun maker

The Connecticut Supreme Court is scheduled to rule on whether gun maker Remington can be sued for making the Bushmaster rifle used to kill 20 children and six educators at Sandy Hook Elementary School in 2012.
Justices are split on the question as the court is scheduled to release majority and dissenting opinions Thursday.
The plaintiffs include a survivor and relatives of nine people killed in the massacre. They argue the AR-15-style rifle used by shooter Adam Lanza was designed as a military killing machine and is too dangerous for the public, but Remington glorified the weapon in marketing it to young people.
A lower court judge dismissed the lawsuit in 2016, agreeing with Remington that federal law shields gun makers from liability when their products are used in crimes. |

Ohio Republicans defending state congressional map in court

Attorneys for Ohio Republican officials will call witnesses this week to defend the state's congressional map.
A federal trial enters its second week Monday in a lawsuit by voter rights groups that say the current seats resulted from "an unconstitutional partisan gerrymander." Their witnesses have included Democratic activists and voters who have expressed frustration and confusion with districts that have stayed at 12 Republicans, four Democrats, since they were drawn ahead of the 2012 elections.
Attorneys for the Republican officials being sued say the map resulted from bipartisan compromise, with each party losing one seat after population shifts in the 2010 U.S. Census caused Ohio to lose two congressional seats.
Among potential GOP witnesses is former U.S. House Speaker John Boehner (BAY'-nur) of West Chester, Ohio. |

Liberals eye 2020 takeover of Wisconsin Supreme Court

Wisconsin liberals hope to take a key step this spring toward breaking a long conservative stranglehold on the state's Supreme Court, in an election that could also serve as a barometer of the political mood in a key presidential swing state.
If the liberal-backed candidate wins the April 2 state Supreme Court race, liberals would be in prime position to take over the court when the next seat comes up in 2020 — during a presidential primary when Democrats expect to benefit from strong turnout.
The bitterly partisan court, which conservatives have controlled since 2008, has upheld several polarizing Republican-backed laws, none more so than former GOP Gov. Scott Walker's law that essentially eliminated collective bargaining for public workers.
If liberals can win in April and again in 2020, they would have the majority until at least 2025.
"It is absolutely critical we win this race," liberal attorney Tim Burns, who lost a Wisconsin Supreme Court race in 2018, said of the April election. "It does set us up for next year to get a court that's likely to look very differently on issues of the day like voters' rights and gerrymandering."
The court could face big decisions on several partisan issues in the coming years, including on the next round of redistricting that follows the 2020 Census, lawsuits challenging the massive Foxconn Technology Group project backed by President Donald Trump, and attempts to undo laws that Republicans passed during a recent lame-duck session to weaken the incoming Democratic governor before he took office. |
